"Under Shari'ah guidelines, if two people are speaking alone and one of them makes some kind of signal to ask for privacy even by as little as just looking over his shoulder, then in principle the contents of that conversation are secret. The same would go for email/sms conversations where there is some kind of indication of confidentiality being requested, even if not explicitly.
