I would disagree wth u as ijma dd took place durng hs lifetime
as in battle of uhad whn he consulted companions , the majority said to fight outside madinah whereas HOLY PROPLHET [S.A.W] himself wanted to defnd city bt he gave up his opinion in front of ijma
I don't think that was ijma... The Holy Prophet CONSULTED his companions and as the majority were of the view that the battle should be fought outside the city, he gave in...

firstly that was just an example on daily life human choices sceondly, the examiner doesn't even refer to Shia or sunni. This question is from 2009, and if you are a sir then you should know that papers before 2005 were made differently one for Sunnis and the other for shias. after 2005, the pattern changed and no different papers were made for shias and sunnis. you are mistaking this very question for a question in the 2003/2004 papers in which a question is about why do Shia scholars reject the use of Qiyas. this question asks why do scholars reject Qiyas. You are saying that Shia scholars reject Qiyas but in the question it is not mentioned so how can you say it!!!!!!
Viper the question asked why do some scholar reject the use of Qiyas and that some scholars belong to Shia sect and zahiris,what is so hard to understand in this.

sorry dat im takng out the flaws as u want irfan to reply
in the surahs u hav done a lot of parapharasing , u donot need to quote any thng frm given verses as u will read in examiner reports , secondly for ur second surah the answer were quite astonishing 4 me , tell me frm where dd u learn thm
then in the question u need to give a brief background of about a paragraph dat how it was preserved during lifetime of Holy Prophet(S.A.W)
and above all thx paper is of oct/nov 2011 not of 2012

well faizan the primary sources of Shariah are used collectively
in the first paragraph, just give out some details about what is Quran and Hadith
in the second paragraph, mention that Quran contains all the details but some details are not discussed by the Quran or are not fully explained. bu the Hadith elaborates and explains tha non-discuused topic of the Quran
in the third paragraph write that the Quran says ,"Establish regular prayers" Prophet said "there is no prayer for the one who does not recite the opening chapter of the book"
4th para : Quran says "and establish regular prayers and pay the charity tax" but no reference as to how much Zakat hadith, "There is no charity tax..."
5th para: Quran says "cut off the hands of the male and female theives" but no reference as to how much amount stolen then this action take place hadith says that his hand should only be cut if he steals something equal to dinar
6th prara: Quran says "O children of Adam, We Have Revealed unto you...but noreference as to which parts to be exposed or covered and from whom Prophets Hadith
7th para : Quran says that wine are forbidden as well as strong drinks but prescribes no punishment Hadith says that 40 lashes be lashed to consummator
8th para : Optional to mention adultery

In Noble Qur’an and in the hadiths drinking alcohol is declared as haram hence it is prohibited and for the violators Hadd punishment is ordered as a punishment in this world. However a there is no clear type and measure of punishment for the afterlife is indicated since the punishment in the afterlife will vary from individual to individual.

We understand that the reason why in the Noble Qur’an has no prescribed certain punishment for drinking alcohol and gambling is because these are personal sins which does not involve any invasion of other people’s rights. That is why the punishments in the Noble Qur’an should be perceived based on this principle. From this perspective we can also consider and interpret this as: The Noble Qur’an has not prescribed any certain punishment for those who abandons the basic requirements of Islam faith such as praying, fasting, alms, and hajj. Allah says “It is for sure that they will return to us. It will be our job to deal with their accounts accordingly.”(Surat al Gasiya: 25-26) which it means every human being will be judged accordingly for their doings in this world.
In some hadiths the type of punishment in the afterlife is told. Sunen patrons tell the story where Mohammed (sallallahu aleyhu vesellem) said: Who drinks alcohol will have his prayers lacking for forty (40) days. If he repents and ask for forgiveness Allah will forgive him. If he keeps doing it after his fourth repentance then Allah will make him to drink the essence of a deadly poison, he surely will deserve that. Then they asked him: O’ Mohammad (sallallahu aleyhu vesellem) what is the essence of the deadly poison? He replied: It is the poison that is in the body of the occupiers of hell. Who would drink alcohol since very young age without considering what is halal what haram is, then Allah will make him drink the poison which is from the body of the hell’s occupiers, and he would deserve that. (C.3, sahi.126-130)
Mohammad (sallallahu aleyhu vesellem) has damned the one who makes alcohol, who orders it, who drinks it, who carries it, who orders it to be delivered to him, who distributes it, who sells it, who spends the money that is earned from it, who buys it and who orders it to be bought for himself.
In Taberani’s story it is said that “In the afterlife Allah will make wine haram to those of you who among my community will die drinking wine. ” (Mecmau’z-Zevaid, 5/146)
Drinking alcohol is definitely prohibited in Surat al Maida verse 90. However the punishment is set through Mohammad’s (sallallahu aleyhu vesellem) application and hadith. Mohammad (sallallahu aleyhu vesellem) and Ebû Bekir (radı-yallahu anh) has punished the violators with 40 times beating with a stick. During the time of Omar (radı-yallahu anh) when alcohol drinkers were getting more and more he consulted his friends and decided to punish the violators with 80 beatings with a stick which is the lightest form of Hadd punishment. (Dârimî, Hudûd,10; A. b. Hanbel, IV, 389).
A man who drank alcohol was brought to Mohammad’s (sallallahu aleyhu vesellem) presence, Mohammad (sallallahu aleyhu vesellem) beat him, they brought him again, he beat him again, they brought him again and he beat him again. (Abû Dâoûd, Hudûd 35-37)

well loads of shame on you a so called o level examiner responds so badly and grumpily and talks shit against those who contradict him which means that you think yourself as perfect and that nobody can contradict you . well I am just going to ignore you just as the Prophet (S.A.W) ignored the taunts of the Quraish. If you can't be a rolemodel for others then why shouldn't I. So you can go on barking all night just like you usually do

well he started the use of foul language at first I kept to my limits respecting him but if you can go back to the one comment which I sent contradicting him and the 6 comments which he sent me copy pasting it from the internet and using extremely foul language who does he think he is claiming to be a so called o level examiner if he can't stick to his tongue then neither can I
u two keep on blaming each other , both of u r wrong u both shod keep in limits n hold ur temper , not good 4 either of u
